1. Introduction

Welcome to WaifuPixel. These Terms of Service ("Terms") govern your access to and use of the WaifuPixel website, platform, and AI-powered image and video generation services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. Please read them carefully before using WaifuPixel.

2. Acceptance of Terms

By creating an account, purchasing credits, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. You must be at least 18 years old to use WaifuPixel.

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Keep your login credentials secure and confidential
Notify us immediately of any unauthorized access to your account
Maintain only one account per person

4. Credits and Payments

WaifuPixel operates on a credit-based system. Credits are used to generate AI images and videos. By purchasing credits, you agree to the following:

All credit purchases are final and non-refundable
Credits never expire and remain in your account until used
Credits are non-transferable between accounts
Credit costs for generation vary based on image size and video duration (1-4 credits for images, higher for videos)

5. AI-Generated Content

When you use WaifuPixel to generate images or videos, the following terms apply:

You retain ownership of content you generate using your credits
Generated content may be used for personal and commercial purposes
We do not guarantee specific results from any generation request
AI-generated content may occasionally produce unexpected or imperfect results

6. User Content and Uploads

When uploading reference images or content to our Service, you represent and warrant that:

You own or have the necessary rights to use and upload the content
Your content does not infringe on any third-party intellectual property rights
Your content complies with our content guidelines and applicable laws
You grant WaifuPixel a license to process your uploads for the purpose of providing the Service

7. Prohibited Uses

You agree not to use WaifuPixel to:

Create content that violates any applicable laws or regulations
Generate content that is defamatory, threatening, harassing, or promotes violence
Create content depicting minors in inappropriate or harmful contexts
Generate content that impersonates real individuals without their consent
Upload malicious files or attempt to compromise our systems
Bypass or attempt to bypass any access restrictions or security measures
Resell access to the Service or generated credits to third parties

8. Intellectual Property

The WaifuPixel platform, including its design, features, AI models, templates, and branding, is owned by WaifuPixel and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service without explicit written permission. The creative templates and system prompts provided are proprietary to WaifuPixel.

9. Community Marketplace

The Community Marketplace allows creators to share and monetize their prompts and models. By participating as a creator, you agree to the following:

Creator Eligibility: You must have a verified email address and be at least 18 years old to submit creations and earn revenue.
Revenue Share: Creators earn 5% of the credit value for each generation using their submitted content. Revenue share percentages are subject to change with notice.
Quality Standards: All submissions must meet our quality guidelines. We reserve the right to reject or remove any content that violates our standards or policies.
Payment Processing: Creator payments are processed through Stripe Connect. You must complete Stripe's onboarding and comply with their terms. Earnings have a 7-day settlement period, and minimum withdrawal is $10 USD.
Content Ownership: You retain ownership of your submitted prompts and models but grant WaifuPixel a non-exclusive license to use, display, and distribute them through our platform.
Content Moderation: We reserve the right to review, moderate, or remove any marketplace content at our discretion. Repeated violations may result in suspension from the marketplace program.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY NOT ALWAYS MEET YOUR EXPECTATIONS. WE ARE NOT RESPONSIBLE FOR ANY CONTENT GENERATED BY USERS OR THE AI MODELS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAIFUPIXEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO WAIFUPIXEL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Any unused credits may be forfeited upon termination for cause. You may delete your account at any time through your account settings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
